In the interest of employee relations, some employers may decide to pay their staff even though they may not have fulfilled their expected hours.
Other employers similarly affected do not, however, have carte blanche to treat their employees in the same way. There must be a clause in the employees’ contracts permitting the employer to reduce pay in such circumstances, commonly known as a lay off close. If no other alternative can be found e.g. annual leave etc, and employers reduce pay without the operation of this clause, they risk a claim at tribunal.
